Terms of Service

1. Acceptance of Terms

By accessing or using the Vidiking platform ("Service"), including the API, website (vidiking.com), and associated tools, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Vidiking provides a pay-as-you-go API platform for video rendering, image generation, AI voiceover, and related media processing services. The Service includes a REST API, web dashboard, visual editor (Studio), SDKs, and integrations.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old to create an account.

4. Payment, Billing, and Refund Policy

Vidiking operates on a prepaid wallet model. You deposit funds into your wallet and operations deduct from your balance.
All deposits are processed through Stripe. An admin fee is applied to cover payment processing costs.
Deposits are non-refundable except as required by applicable law.
Wallet credits expire 12 months from the date of deposit.
Pricing is listed in USD and may change with 30 days' notice.

4.1 No refunds for compute already consumed. Vidiking is an aggregator of upstream AI providers (including but not limited to fal.ai/Kling, Runway, OpenAI, ElevenLabs, Replicate, Anthropic, Google). The moment you press render / generate / submit, Vidiking is billed in real time by those providers for the compute you triggered. Once compute has been consumed by an upstream provider, the cost is non-refundable on our side under any circumstances.

4.2 Refunds are pass-through only. We will only issue a refund where, and to the extent that, the upstream provider first refunds Vidiking for the same operation. If a third-party provider does not refund us, we cannot refund you — the funds have already left our account. This is true even if:

You did not like the output, the output was off-prompt, or you changed your mind after pressing the button.
The output was rejected by our local quality checks (the provider already billed us for the failed render).
You hit the wrong button, mis-configured your batch, or supplied bad inputs.
You experienced a network or browser issue after the request was already submitted to the provider.

4.3 Provider-error refunds. Where an upstream provider returns a refundable failure status (e.g. provider 5xx, 401/403/429, or an explicit refund credit on our account), Vidiking automatically credits your wallet for that operation. This is the only category of automatic refund and is processed without you having to ask.

4.4 Disputed charges and chargebacks. If you believe a charge was made in error, contact support@vidiking.com within 14 days. Initiating a Stripe chargeback or payment-network dispute without first contacting support will result in immediate account suspension and forfeiture of any remaining wallet balance. Chargebacks initiated for compute already delivered to you are considered a breach of these Terms.

4.5 Platform-error refunds. If a job fails due to a verified Vidiking platform error (i.e. our infrastructure, not the upstream provider), the charged amount is refunded to your wallet automatically. The sweeper-recovered "stuck batch" path described in section 10 falls under this clause.

5. Acceptable Use

You agree not to use the Service to:

Generate illegal, harmful, or abusive content
Create deepfakes or misleading media intended to deceive
Violate any applicable laws or regulations
Interfere with or disrupt the Service or its infrastructure
Reverse-engineer, scrape, or resell the Service without authorization
Exceed reasonable usage patterns or abuse the API

6. Content and Intellectual Property

You retain all rights to content you upload or generate through the Service. Vidiking does not claim ownership of your content. You grant Vidiking a limited license to process your content solely to provide the Service.

Generated content using third-party AI models (DALL-E, Runway, ElevenLabs, etc.) is subject to the respective provider's terms and usage policies.

7. API Keys and Security

You are responsible for keeping your API keys confidential. Do not share keys publicly or embed them in client-side code. Vidiking is not liable for unauthorized usage resulting from compromised credentials.

8. Whitelabel and Reseller Use

Whitelabel features allow you to resell Vidiking services under your own brand. You are responsible for your end users' compliance with these Terms and for providing appropriate terms of service to them.

9. Connected Destinations and OAuth

Vidiking lets you connect third-party destinations — including TikTok, YouTube, Instagram, Facebook, Vimeo, Google Drive, and Dropbox — so that finished videos can be published directly to accounts you own. Connecting a destination grants Vidiking a limited authorisation, strictly scoped to the permissions you approve during the OAuth consent screen, to publish content on your behalf.

We publish to a connected destination only when you have marked it active and a render job targets it, or when you explicitly invoke a delivery endpoint.
We do not read your feed, followers, direct messages, or any account data beyond the basic profile information needed to label the connection (for example, the display name shown on your Destinations page).
You are responsible for complying with each destination's own terms (e.g. TikTok's Community Guidelines apply to anything published through Vidiking to TikTok).
You can disconnect a destination at any time from the Destinations page. We delete the stored OAuth token within 24 hours of revocation.

10. Videofactory (Daily Batch Generation)

Videofactory lets you generate up to 50 short-form videos in a single batch. Because batch jobs hold compute on third-party AI providers, the following terms apply on top of the general payment and acceptable-use clauses above:

Per-clip pricing. Each video in a batch is priced individually based on its duration (10s, 20s, 30s or 60s). The total batch charge is the sum of per-video charges and is shown to you for confirmation before the batch starts.
Wallet hold. The full success-path total is held from your wallet when the batch is created. Per-clip refunds (see below) are credited back to the wallet as the batch progresses.
Provider failures are auto-refunded (pass-through). If a clip fails because the underlying AI provider returned a refundable error status (server error, rate-limit, auth failure, or explicit refund), that clip's charge is automatically credited back to your wallet. This is a pass-through of the provider's own refund to us; per section 4.2 we cannot refund clips where the provider has already been billed for the compute.
Quality failures are not refundable. If a clip renders but is rejected by our local quality checks (frozen frames, malformed output, off-prompt content, etc.), it is not refunded — the upstream provider has already billed us for the compute the moment you pressed Generate. You will see the failed clip in your dashboard and can retry manually if you wish, which is a separate billable operation.
"Pressed by mistake" is not refundable. Once you submit a batch and the wallet hold is placed, upstream providers begin charging us in real time. We cannot reverse those provider charges, so we cannot reverse the corresponding wallet deductions. Always use Preview Cost before pressing Generate.
Output retention. Per-video MP4s and the bundled ZIP are retained for the duration tied to your storage plan. After your retention window expires, both the per-video files and the ZIP are deleted from our storage automatically. Download to your own device for permanent access.
ZIP availability. The bundled ZIP is built once all videos in the batch reach a terminal state. If ZIP generation fails (very rare), the per-video MP4s are still individually downloadable from your dashboard.
Stuck batches. If a batch sits in PROCESSING for over 60 minutes without activity (e.g. due to a Vidiking outage), our recovery sweeper marks it FAILED and refunds any clips whose compute had not yet been consumed.

11. Service Availability

Vidiking aims to provide reliable service but does not guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, upgrades, or due to circumstances beyond our control. We are not liable for losses resulting from service interruptions.

12. Data Retention

Rendered output files are retained for 30 days unless otherwise configured.
Sandbox output is retained for 24 hours.
Account data is retained for the duration of your account.

13. Limitation of Liability

To the maximum extent permitted by law, Vidiking shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

14. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time. Upon termination, your wallet balance is forfeited unless required otherwise by law.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the platform. Continued use after changes constitutes acceptance of the updated Terms.
